Which rules apply for restaurants, bars and eating places?

Restaurants, bars and eating places can open their indoor and outdoor areas. Different rules apply according to the model chosen („2-G-model“ or „3-G-model“).

3-G-model

  • It is mandatory to adhere to the hygiene rules.
  • A protection concept must be established.
  • The guests‘ contact information must be documented (digitally).
  • It is only allowed to consume and serve food at tables.
  • Only persons for whom the distance rule according to §3 paragraph 2 sentence 2 does not apply are allowed to sit together at the same table. Max. 10 persons from different households can sit together at a table. Vaccinated and recovered persons are not counted among these 10 persons if it is a private gathering according to the exceptional decree on COVID-19 protection measures for vaccinated and recovered persons made by the Federal Government.
  • It is only admitted under certain conditions to consume food and drinks at standing places.
  • The seats and standing places must be arranged in a way that a distance of at least 1,5 meters can be maintained between the groups of guests. Otherwise, appropriate partition walls can be installed between the guests.
  • It is mandatory to present a negative corona test result when using indoor areas.
  • The staff members and all guests must wear a medical mask. It is only allowed to take off one’s mask outdoor and when sitting on a fix seat (indoor).
  • A curfew applies for the indoor areas (11:00 p.m. – 5:00 a.m. of the following day).
  • It is allowed to sell food and drinks for takeaway (or delivery). However, it is prohibited to consume the food on the spot or in the close proximity of the restaurant.
  • It is prohibited to sell alcoholic drinks in cups or glasses for takeaway. However, it is allowed to sell customarily packed drinks in cans or bottles.   • Shishas and water pipes may only be used outdoor.

2-G-model

  • The hygiene rules must be adhered to.

  • The staff members and all guests must wear a medical mask. It is only allowed to take off one’s mask outdoor and when sitting on a fix seat (indoor).
  • It is allowed to sell food and drinks for takeaway (or delivery). However, it is prohibited to consume the food on the spot or in the close proximity of the restaurant.
  • It is prohibited to sell alcoholic drinks in cups or glasses for takeaway. However, it is allowed to sell customarily packed drinks in cans or bottles.   • Shishas and water pipes may also be used indoor.

A curfew applies for the indoor areas between 11:00 p.m. and 5:00 a.m. of the following day. Attention: In some detemined areas of the city, the curfew also applies for the outdoor areas (see information here).

Is it mandatory to book a seat?

No, there is no obligation to book a seat beforehand. However, it is mandatory to submit and document contact information (digitally).

Do guests need a negative test result or an evidence of their vaccination?

There is no obligation for doing a test at the outdoor areas of restaurants. However, it is mandatory to present a negative corona quick test result (not older than 24 hours) or a negative PCR test result (not older than 48 hours) if you wish to attend the indoor area of a restaurant having chosen the 3-G-model. It is also allowed to present an evidence for your vaccination or recovery instead of a negative quick test result; these documents replace the tests.

There is no obligation for testing in restaurants having chosen the 2-G-model.

How many persons can sit or stand together at the same table?

The number of persons admitted at the same table depends on the choice of the model. If the 3-G-model is chosen, max. 10 persons are allowed to sit or stand together at the same table. Children under the age of 14 years are not counted. Vaccinated and recovered persons are not counted among these 10 persons if it is a private gathering according to the exceptional decree on COVID-19 protection measures for vaccinated and recovered persons made by the Federal Government.

The distance rules does not apply in restaurants having chosen the 2-G-model – this means that the number of persons sitting or standing at the same table is not limited.

Is it mandatory to document the guests‘ contact information via the corona warning app or the Luca app?

The guests‘ contact data must be documented, either on a paper list or digitally. Companies and businesses can use the Luca app because it has an interface with the health authorities. Other apps can be used, too.
The operators of a business must make sure that the guests get connected to the app, and they have to control this. Otherwise only the number of connected persons is visible.
Persons who do not use the app must be documented on paper lists or via the Luca database.

Is it mandatory to wear a mask in a restaurant?

All guests and staff members (also when they are vaccinated or have recovered from an infection with the corona virus) must generally wear a medical mask in the whole restaurant / eating facility (outdoor, indoor, sanitary facilities). Guests may only take off their mask when they are sitting at their assigned seat.

How are vaccination and test evidence of staff members supposed to be monitored and documented?

The following certificates are approved:

  • The tests and their results must be documented in a „test logbook“ on paper or digitally (in compliance with § 10e of the legal decree in order to reduce the spread of SARS-CoV-2 in Hamburg of 20.05.2021).
  • For vaccinated persons, the vaccination certificate is considered as evidence.
  • For recovered persons, the PCR test is considered as evidence.
  • For tested persons, the digital or analogue certificate of the test result ist considered as evidence.

Is it allowed to serve alcohol?

It is allowed to serve alcohol for direct consumption in the open-air areas of restaurants.

Attention: There are still public places and streets where a temporary prohibition of alcohol consumption applies (see § 4d). For example: If there is a beer garden at such a place, it is allowed to drink alcohol at the tables of this beer garden, but not „in close proximity“ to the beer garden.

Which rules apply for the outdoor areas of restaurants?

It is permitted to open the outdoor areas of restaurants. Different rules apply according to the model chosen („2-G-model“ or „3-G-model“).

3-G-model

  • It is only permitted to consume food and drinks at the tables. 
  • Contact information must be collected in compliance with § 7.
  • The seats or standing places for guests must be arranged in a way that a distance of at least 1,5 meters can be maintained between the guests for whom the distance rule according to §3 paragraph 2 applies.
  • It is permitted to use sanitary facilities indoor (you have to wear a mask there and also on the way from your table to the bathroom, and you must keep distance from other persons present).
  • The operators must make sure that the employees adhere to the obligation to wear a mask according to § 8.
  • Shishas or other water pipes can be used in outdoor areas.

2-G-model

  • The guests‘ contact information must be documented (digitally).
  • It is allowed to use shishas or other water pipes.
  • It is also admitted to consume food and drinks at standing places.
  • Tables and chairs can be arranged freely. 

Are company canteens and staff restaurants allowed to open?

No. Company canteens accessible by the public must remain closed. However, it is permitted to sell food and drinks for takeaway. It is prohibited to eat and drink on the spot.

Canteens and staff restaurants without public access are only allowed to open if they are urgently necessary in order to maintain the company’s business. In these cases, the hygiene rules must be adhered to. It is prohibited to open canteens to the general public.

For facilities benefitting from the exception according to § 15, section 2, 2a and 3, the following rules apply:

  • It is mandatory to adhere to the general hygiene rules.
  • The seats or standing places for guests must be arranged in a way that a distance of at least 1,5 meters can be maintained between the guests. Otherwise, appropriate partition walls must be installed between the guests.
  • It is prohibited to serve alcoholic drinks from 9:00 p.m. until 10:00 a.m. of the following day
  • All persons present indoor must wear a medical mask covering their mouth and nose. This applies also for staff members. Guests are allowed to take off their masks when seated. Please see also §8 of the legal decree.
  • The operators must make sure that the employees adhere to the obligation to wear a medical mask according to § 8. This means that all staff members must wear a medical mask, too.

Am I allowed to open my bar or tavern?

Why do the guests have to submit their contact information?

In the event that new infections occur after a visit in a bar or restaurant, the contact information submitted by the guests allow to retrace the infection chains. The operators must collect the contact information. 

The following rules apply:

  • Guests must submit their complete name, address and phone number correctly. The operator must record the contact information mentioned above.
  • Contact data must be submitted in writing, indicating the exact date and time of the visit, and have to be kept for 4 weeks (storage period).
  • The operators of the facilities, the commercial premises, the business spaces, the bars, the restaurants, the accomodation facilities or the salesrooms must make sure that the contact information submitted by the guests are complete, and check whether these information are obviously false (check for plausibility).
  • Persons refusing to submit their contact information or obviously submitting false or incomplete information must be expelled.

Please note: Due to data protection regulations, the contact information of the guests must not be accessible to the public. They must be deleted or destroyed after the storage period. It is prohibited to give these data to unauthorized persons.

Are shisha bars allowed to open?

It is allowed to provide shishas and water pipes. Different rules apply according to the model chosen („2-G-model“ or „3-G-model“):

3-G-model

  • Shishas and water pipes may only be used outdoor.
  • It is mandatory to make sure that shishas and other water pipes are only used by one person. Furthermore, it is mandatory to use disposable tubes and disposable mouth pieces. The water pipes must be cleaned after each use.
  • Guests must submit their contact information which must be checked for plausibility (completeness and obviously wrong information).
  • The seats or standing places for the guests must be arranged in a way that a distance of at least 1,5 meters can be maintained between the guests. This does not apply for groups who do not need to adhere to the distance rule.

2-G-model

  • Shishas and water pipes may also be used indoor.
  • It is mandatory to make sure that shishas and other water pipes are only used by one person. Furthermore, it is mandatory to use disposable tubes and disposable mouth pieces. The water pipes must be cleaned after each use.
  • Guests must submit their contact information which must be checked for plausibility (completeness and obviously wrong information).

When will the closing hour apply?

The sale and supply of alcoholic drinks is prohibited from 10:00 p.m. until 6:00 a.m. of the following day. Serving alcohol is prohibited from 10:00 p.m. until 10:00 a.m. of the following day.

It remains permitted to sell food and non-alcoholic drinks for takeaway. The sale of alcoholic drinks is prohibited from 10:00 p.m. until 6:00 a.m. of the following day. 

The police can also prohibit the sale and supply of alcoholic drinks in certain places at other points of time, in the event that people gather and drink alcohol together in public and do not adhere to this decree in these places or the direct environment. 

Can I still order food at restaurants or delivery services?

Yes, it remains permitted to sell food and drinks for takeaway. It also remains permitted to deliver food.

Please note the following information:

  • It is prohibited to sell alcoholic drinks for takeaway from 10:00 p.m. until 6:00 a.m. of the following day
  • It is prohibited to consume the purchased food and drinks on the spot or in the direct surroundings of the point of acquisition.
